In terms of Information Technology Act, 2000, this document is an electronic record. Being generated by a computer system it does not require any physical or digital signatures.
This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of https://www.hatvet.com
For the purpose of these Terms of Service, wherever the context so requires the term ‘You’/ ‘User’ shall mean any natural or legal person who has provided Registration Data while registering on https://www.hatvet.com in any internet browser. Any services provided by the Online portal which do not require registration do not absolve you of the contractual relationship established by this Agreement.
Wherever the context requires, the term ‘Veterinarian’ shall mean any person permitted to practice veterinary medicine by the VCI (Veterinary Council of India) or any State council for registration of Veterinarians/ Animal practitioners duly authorized by the government who will be verified and authenticated by us.
By using our portal, you are bound by these Terms of Service and any other binding document as decided by the Company. You are requested to read them carefully before accepting the same and moving forward to using https://www.hatvet.com.
By visiting, viewing, accessing or otherwise using any of the services or information created, collected, compiled or submitted to www.hatvet.com, you are deemed to have agreed to all the following Terms and Conditions. So, before you use this online portal, please read these Terms carefully as you agree to be bound by them. If you do not accept these Terms and Conditions, please do not use this portal.
1.CREATING AN ACCOUNT:
1.1 To use certain features of the Online portal (e.g., ordering Products, posting rating/reviews, receiving HATVET enewsletters), you must set up an account with Hatvet.com (“HATVET Account”) and provide certain information about yourself as prompted by the Customer Information form. All of your registration information is protected by our Privacy Policy.
1.2 You represent and warrant that the information you submit during registration is truthful and accurate and that you will maintain the accuracy of such information.
1.3 Your HATVET Account username and password are personal to you. You may not transfer your account and you will be responsible for the activities associated with your HATVET Account.
1.4 Hatvet.com will not be liable for any loss or damages as a result of your failure to maintain the confidentiality of your account credentials. If you suspect any unauthorised use of your HATVET account, you shall immediately notify Hatvet.com.
1.5 It is your responsibility to keep your email address up-to-date on your account setup at Hatvet.com so that we can communicate with you electronically.
1.6 By creating this account you agree to receive communications from us via email, telephone, SMS and chat. If you, at any time, wish to discontinue receiving communications from us, you agree to notify us by email.
2. PRIVACY POLICY:
2.1 Your personally identifiable information will be used in accordance with our Privacy Policy. To understand our practices, as to how we collect, use and disclose your personally identifiable information, please refer our Privacy Policy, which also governs your visit to Hatvet.com.
2.2 We understand the privacy of all information you provide is of a primary importance. This is why we do everything possible to use it carefully and sensibly. This information is never shared with other companies or third party service providers.
3. COMMUNICATIONS
By using this Online portal, it is deemed that you have consented to receiving calls, auto-dialled and/or pre-recorded messages or calls, from us at any time with the use of the telephone number that has been provided by you for the use of this Online portal, subject to the Privacy Policy. Such contact will be made only in pursuance of the respective contracts, agreements and/or policies.
The sharing of the information provided by you will be governed by the Privacy Policy. We will not give out your contact information to third parties not connected with the Online portal and the services offered by it, and/or for any purpose not in furtherance of the activities and aims of the Company. 4.SECURITY POLICY:
All your transactions are secure when you place an order online at Hatvet.com. Your personal information is encrypted with TLS_ECDHE_RSA_WITH_AES_256_CBC_SHA, 256 bit keys, TLS 1.2 encryption technology before being sent over the Internet, which ensures the privacy and high level of security of all your information.
5. CUSTOMER MEMBERSHIP/USAGE/ELIGIBILITY:
The membership/usage of the Online portal is restricted to Veterinarians or Organizations authorized by Veterinarians.
Further, you are solely responsible for protecting the confidentiality of your username and password and any activity under the account will be deemed to have been done by you. In the case that you provide us with false and inaccurate details or the Company has reasonable reasons to believe you have done so, we hold the rights to suspend your account and/or terminate this Agreement without any notice and without being held liable for the same.
You understand that we may automatically upgrade https://www.hatvet.com and these Terms shall apply to the upgrades as well. We reserve the right to terminate this agreement without any notice and suspend the account without assigning any reason.
6. PRICE AND PAYMENT:
For the purpose of this section, Buyer would include any user choosing to use the services offered on our Portal. Seller means Us/Online portal/ the Company.
While availing any of the payment methods available on https://www.hatvet.com, We will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to:
i. Lack of authorization for any transaction(s), or
ii. Exceeding the preset limit mutually agreed by you and between ‘Bank(s)’, or
iii. Any payment issues arising out of the transaction, or
iv. Decline of transaction for any other reason(s).
All payments made against the services on https://www.hatvet.com by you shall be compulsorily in Indian Rupees. The Online portal will not facilitate transaction with respect to any other form of currency with respect to the purchases made on Online portal.
6.1 We make every effort to make sure that the pricing and availability of Products on our Online portal is accurate and up to date. However, rarely, there may be an error on the pricing of a product or an error related to product availability. In such cases, we are not responsible for any typographical errors and we reserve the right to cancel the sale.
6.2 We reserve the right to correct any inaccuracies or omissions related to pricing and product availability/descriptions, even after you have submitted your order, and to change or update any other information at any time without prior notice.
6.3 Delivery times may vary depending on the delivery location as well as the type of product you order.
6.4 You can make the payment via any one of the following methods of payment: Credit/Debit Card, Net Banking or Cash on Delivery. Other mode of payments may also be facilitated by us from time to time.
6.5 Credit/Debit Card and Net Banking Payments are processed via our online payment service partners.
7. USER OBLIGATIONS:
You are a restricted user of this Online portal.
7.1. You acknowledge and agree that by accessing or using the Online portal or Services, you may be exposed to content from other users that you may consider offensive, indecent or otherwise objectionable. 7.3. This Online portal by nature allows you to upload information; you undertake to ensure that such material is in accordance with applicable laws of the Indian subcontinent. Also you are NOT allowed to use the Online portal or any material or Content for any purpose that is unlawful or prohibited by these Terms of Service, or to solicit the performance of any illegal activity or other activity which infringes the rights of this Online portal or other third parties; While we shall not be held liable or answerable to Users for any such acts on your part, violation of this clause would lead to potential criminal legal action against you, either by other Users of the Online portal or by us.
We can (and You hereby expressly authorize Us to) disclose any information about you to law enforcement or other government officials, as we, in our sole discretion, believe necessary or appropriate in connection with the investigation and/or resolution of possible crimes, especially those that may involve personal injury. You understand that we have the right at all times to disclose any information (including the identity of the persons providing information or materials on the Online portal) as necessary to satisfy any law, regulation or valid governmental request. This may include, without limitation, disclosure of the information in connection with investigation of alleged illegal activity or solicitation of illegal activity or in response to a lawful court order.

We reserve the right to remove or alter any of the information contained on the Online portal at our sole discretion.

8.5 We disclaim responsibility for any harm to pets resulting from any instructions or Products referred to in the Online portal. We do not warrant that the Online portal, or its content will meet your pet’s requirements.
8.6 Please note that while HATVET has made every effort to accurately display the colours of products on its Online portal, the actual colour you see will depend on your monitor. We cannot guarantee that your monitor’s display of any colour will be the same as the colour of the Products delivered to you. Also, product images displayed on the portal may be different from actual images of products, owing to technical/ other limitations/ variations.
8.7 We may let you view our information and communicate with us through the Social Media services such as Facebook and Twitter. HATVET explicitly disclaims any responsibility for the terms of use and privacy policies that govern these third-party websites, which are in no way associated with us.
8.8 Hatvet.com accepts no responsibility for any loss or damage suffered due to your reliance on the product reviews posted by the HATVET Users.
8.9 Hatvet.com reserves the right to modify or withdraw any part of the online portal or any of its content at any time without notice.
9. PORTAL AVAILABILITY:
We take all reasonable care to ensure the availability of the Hatvet.com Online portal 24 hours every day, 365 days per year. However, the Online portal may become temporarily unavailable due to maintenance, server or other technical issues, or for reasons beyond our control. Hatvet.com does not warrant uninterrupted access to this Online portal or any linked online portal. However, we may, but shall not be obliged to, issue a notice when we know of scheduled maintenance of our Online portal.
10. LINKS TO THIRD-PARTY WEBSITES:
We provide link to third-party websites, our online payment service partners, which process your Net Banking and Credit/Debit Card payments, respectively. We are not responsible for the availability or proper functioning of such linked pages or sites, and we will not be held responsible for any loss or inconvenience encountered as a result of using such Website link.
11. TERMS OF SALE:
11.1 Hatvet.com may accept or decline any order placed by a Customer (you) in its absolute discretion without liability to you.
11.2 Hatvet.com reserves the right to discontinue any promotion or offer on its Online portal.
11.3 We reserve the right, without prior notice, to limit the order quantity of any Products available on Hatvet.com.
11.4 To enter into any sale transaction, you agree that you have registered on our portal as a registered Veterinarian recognized by Veterinary Council of India or State Council or an Organization authorized by a Veterinarian who is registered at our portal.
12. CANCELLATION, RETURN AND REFUND POLICY:
Refund Policy:
At Hatvet.com, we do our best to ensure that you are completely satisfied with our products. And we are happy to issue a refund based on the conditions listed below:
Refund Possible If:
• you received a defective item;
• the ordered item(s) is lost or damaged during transit;
• the ordered item(s) is past its expiry date.
Please note: Mode of refund may vary depending on circumstances. If the mode of refund is by Credit/Debit Card or Net Banking, please allow 20 to 25 working days for the credit to appear in your account. While we regret any inconvenience caused by this time frame, it is the bank’s policy that delays the refund timing and we have no control over that.
How to Request a Refund:

Return Policy:
We do our best to ensure that the products you order are delivered according to your specifications. However, should you receive an incomplete order, damaged or incorrect product(s), please notify HATVET Customer Support immediately or within 10 working days of receiving the products, to ensure prompt resolution. Please note that Hatvet.com will not accept liability for such delivery issues if you fail to notify us within 10 working days of receipt.
We also understand that various circumstances may arise leading you to want to return a product or products that are not defective. In these cases, please note that we do not allow any refund.
Please note that before we ship your orders, submission of required documents by you is compulsory. The documents are clearly listed on Checkout page. In case the customer makes payment but fails to submit the required documents, his order may not be fulfilled and the payment made may become non-refundable or only partially refundable, at the sole discretion of HATVET.
13. USER INDEMNIFICATION:
You hereby agree to indemnify, defend, hold harmless Hatvet.com and its officers, directors, employees, agents, information providers, partners, licensors, advertisers and suppliers from and against all claims, losses, expenses, damages and costs, including reasonable legal fees and costs, resulting from any violation of this agreement, or any activity related to your account, or any information or material you have submitted or will submit to us in violation of any law or in breach of any third party rights (including, but not limited to, claims in respect of defamation, invasion of privacy, or infringement of any other intellectual property right). 15. APPLICABLE LAW AND JURISDICTION:
These Terms and Conditions and your use of this Online portal and its content will be governed by and construed in all respects in accordance with the laws of India subject to the jurisdictional courts of Meerut.
The products offered for sale at our portal, may be restricted for use by Govt. of India / Govt. authorities in certain geographical areas. So you are advised to check with your local/ State Govt. authorities regarding use of that/ those particular product/s in your geographical area. In any situation, the Company will not be liable for any legal violations due to misuse of the products purchased by you at our portal. Hereby you give consent that the products purchased by you at our portal will be used as per law in your geographical area and will not be dispensed to unauthorized/ illiterate/ uninformed people to avoid misuse of the product.
As per laws, the product you purchased at our portal are meant for personal dispensing to your pets. If you re-sale these products to any other person, you are solely responsible for obtaining any/ all required regulatory permission/s from your local/ State Govt. authorities to avoid any legal violations of laws/ rules prevailing in your geographical areas.
16. SEVERABILITY:
If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.
17. DISCLAIMER OF WARRANTIES AND LIABILITIES
WE WILL NOT BE HELD RESPONSIBLE/ LEGALLY BOUND FOR ANY LOSS OR INJURY TO YOU/ YOUR PET/ PET PARENTS BY USING OUR PRODUCTS. THE TECHNICAL INFORMATION PROVIDED (REGARDING USE OF THESE PRODUCTS) ON THIS PORTAL MAY BE SUBJECT TO PRACTICAL VARIATIONS/ INDIVIDUAL SPECIFICITY AND SO FORTH. USER IS DULY ADVISED TO USE OUR PRODUCTS BASED ON HIS/ HER PROFESSIONAL KNOWLEDGE AND EXPERIENCE.

19. TERMINATION:
You agree that Hatvet.com, in its sole discretion and for any or no reason, including without limitation if you breach these Terms and Conditions, may terminate your access to and use of the Online portal, at any time. You agree that any termination of your access to the Online portal or suspension of your account may be effected without prior notice, and you agree that Hatvet.com shall not be liable to you for any such termination. Your right to use the HATVET Online portal /Service immediately ceases upon termination of your access/use of the Online portal.
20. CHANGES TO THESE TERMS AND CONDITIONS:
We reserve the right to amend these terms and conditions from time to time without further notice to you. Any such amendments we make shall be effective once we post a revised version of these Terms and Conditions on the Online portal. It is your responsibility to review the Hatvet.com Terms and Conditions regularly. Your continued use of the Online portal following the publication of any such changes will constitute your agreement to follow and be automatically bound by the amended terms and conditions.
21. MISCELLANEOUS
We reserve the right to change these Terms of Service at any time without notice in its discretion and to notify users of any such changes solely by changing this Terms of Service.
